Student sues barbecue shop for fraud after receiving inconsistent dish in Chongqing

In April 2024, Xiaopan placed an order in a barbecue restaurant, and the consumption amount was $4.5 (about 31 yuan), including a $2.2 (about 15 yuan) fish-flavored shredded pork.

After receiving the meal, Xiaopan found that although there were two cauliflowers and one sausage in the dish, the additional ingredients almost occupied most of the entire dish, but there was not much fish-flavored shredded pork, which was seriously inconsistent with the picture displayed by the merchant when placing the order.

Xiaopan got in touch with the barbecue shop owner to request compensation but was refused. Xiaopan thought the barbecue shop constituted fraud and sued.

The court held that the fish-flavored shredded pork received by Xiaopan had a significant difference from the photo displayed by the merchant on the platform, and there were other dishes with a large proportion mixed in it, which did not conform to the general consumer's perception of this dish, so it was determined that the barbecue shop had a fraud behavior.

Accordingly, the court ruled that the barbecue shop should pay three times the compensation to Xiaopan. Because the compensation amount was less than $73 (about 500 yuan), it was determined to be $73 (about 500 yuan).
